I think it's alright to have live actions ads, as long as there are an equal amount of "in-game" ads.
Live action ads appeal to mainstream media watchers, a demographic that MS's marketing department know all too well.
But for the Video Game Awards, you CANNOT show a live action ad and hope to score with it. It's gotta be game.
Pretty bold to claim that people would get it confused with CG graphics. Kind of puts him on a pedestal, which I think is unnecessary, unless it's going to be a mind blowing trailer.

We should also remember Blizzard is another company that starts things but stops production when it's not up to snuff (ie Warcraft Adventures and Starcraft: Ghost), both projects that received plenty of attention, but never bloomed.
